Lane & Co, In re that a bankruptcy trustee could not abandon debt-encumbered property to the debtor to reduce the bankruptcy estate's tax liability because foreclosure was imminent. The Court found that abandonment violated the fresh start principles of bankruptcy by transferring tax liabilities to the debtor. This decision conflicts with the Eighth Circuit and US Bankruptcy Court of Northern Iowa rulings, so tax professionals should not assume the issue is concluded.
