In the Coast to Coast case, the creditor's committee organized a campaign that increased the payout of unsecured creditors by an additional ten cents to the dollar.

From the supplier: Taxpayers and tax advisors frequently overlook the regulations dealing with insolvency and the alternative minimum tax (AMT) treatment of passive activity loss (PAL) carryforwards. Section 58(c)(1) of the Internal Revenue Code may increase the alternative minimum taxable income because it allows insolvent taxpayers to take PALs for purposes of the AMT. Tax advisors can take steps to minimize the adverse effects of Section 58(c)(1) through proper timing.

From the supplier: The power of a trust in a bankruptcy case is illustrated via a legal case involving Al Copeland Enterprises Inc, owner of two restaurants, and the state of Texas. The center of controversy were the sales tax receipts which, under state law, were held in trust by the business owner for the state. The Bankruptcy Code, on the other hand, excludes any property or money held by the debtor for another entity from being absorbed by creditors. The confusing situation calls for the exercise of restraint and care in developing trust relationships which are of a debtor-creditor nature.
