5-0 out of 5 stars A must have for the legal proffesional or law studnet!
Know of of a lawyer (whom does not already have this indespenseable tool) or of a person heading to law school; then you should buy this book for them, i.e., Black's Law Dictionary by Bryan A. Garner (Editor), et al. The reference book starts out with a pronunciation guide; preface (which is very well written indeed); guide to dictionary; list of abbreviations; dictionary; seven appendixes, legal maxims, the constitution of the united states of america, universal declaration human rights; time chart of the united states supreme court; federal circuita map; british regnal years; list of works cited. The price is abit steep ... but it is well worth its price.

5-0 out of 5 stars Ideal for starting a study of law...
As mentioned in an earlier review, the pocket version of Black's Law Dictionary is ideal for the beginning law student, such as myself. While not as thorough as the unabridged version, it is much more convenient to carry around for one. Second, the concise definitions are ideal for getting the gist of a legal definition. I have found that many of the cases studied in first year classes are seventy to one-hundred-and-fifty years old. As a result, many legal terms used in those cases are a bit outdated. Enter the pocket dictionary, which does an admirable job of giving a concise clear defintion, just right for understanding the term used in the case.

As the semester has rolled along, I have found that I am using the dictionary less, which is natural I suppose since I am becoming more familiar with the language of law. I still keep it handy as a refresher. While the internet does offer many valuable resources for defining legal terms, the pocket dictionary is still a valuable resource for use on a plane, on the bus, or when the internet isn't available in class.

If you are planning on studying law, I would recommend picking up a copy of the pocket version of Black's Law Dictionary.

5-0 out of 5 stars A Better Doorstopper or Child's Booster Seat Can't Be Found
Every first year law student spends the evening before his or her first day of law school examining this weighty tome, leafing through its dense double-columned pages of arcane and obsolete legalese, rolling the syllables of Latin phrases like "consentientes et agentes pari poena plectentur" or "in dubio, pro legi fori" around on the back of the tongue, experimenting with various pronunciations of harsh old Anglo-Saxon terms like "lyef-geld" or "gisle" or "feoffee", and pondering the shaded meanings of such linguistic curiousities as "nudum pactum", "girth and sanctuary" or "estate tail". All of this and more is taken in by the eager law student, who reads on into the night before parking the tome on the shelf and dropping off to sleep. Nine times out of ten, the book thereafter remains unopened, gathering dust, dutifully moving from apartment to apartment, then from office to office in the course of one's legal career (should the law student be so fortunate as to have one). Very occasionally, the student or lawyer may encounter an unfamiliar word or phrase, and Black's Law Dictionary will come down off the shelf for a brief interlude. Those few lawyers who have the time or inclination will marvel at the wealth of legal arcanography contained between the boards of a single volume. One or two might even take it home for bedtime reading. For most, however, it is merely a part of the furniture, little used, underappreciated and generally ignored. Even so, I heartily recommend it, not only as an indispensible part of every lawyer's library furniture, but also as a veritable treasure trove of tidbits such as "lex fingit ubi subsistit aequitas", "tenants by the verge" and "smoke farthings". For sheer power to amaze and entertain, how could this not be one of the ten great books of the English language?

5-0 out of 5 stars Clasic - all law students need a Blacks Law Dictionary
This is a minor cost on top of a major investment.

Also, all 3Ls should get another legal classic, "Common Sense Rules of Advocacy for Lawyers" by Keith Evans.

2-0 out of 5 stars Way too general
This dictionary may be good for the layman, but it is far too general for a law student or lawyer. Only the most common legal words are included, so most of the words are familiar to lawyers. Those words that are obscure enough to require a dictionary are not included. I would recommend this dictionary to a layman who wants to understand simple legal terms, but not to a lawyer or law student.

5-0 out of 5 stars Legal Terms Defined in Everyday Language
This book defines legal terms in easily understood English. In some cases, it gives an example of a situation to which the legal term might apply in order to help illustrate the meaning. It would be a very useful addition to anyone's reference library.

5-0 out of 5 stars Legal Terms
This book is a must for those with no legal background, but don't want to be intimidated by legal "jargon." I found it an easy reference guide to common and not so common legal words used every day. I work in a courtroom, and found the book helpful in understanding the judicial process. ... Read more

Book Description

With double the length and coverage of the original, this new edition of A Dictionary of Modern Legal Usage (DMLU) marshals and analyzes the modern legal vocabulary more thoroughly than any other contemporary reference work can claim to do. Since the 1987 first edition, Bryan A. Garner has drawn on his unrivaled experience as a legal editor to refine his positions on legal usage and to add a wealth of new material. Here's how Garner's revision makes DMLU, Second Edition indispensable:

-- Updates every existing entry, making this a second edition in the fullest sense;

-- Adds hundreds of new entries;

-- Adds hundreds of new sections within existing entries;

-- Adds over 3,000 new illustrative quotations from judicial opinions and leading lawbooks by prominent legal commentators;

-- Reconsiders previously held positions, now saying, for example, that contractions are sometimes permissible in legal writing;

-- Fully elaborates ideas only hinted at in the first edition;

-- Takes into account numerous comments received from first edition users;

-- Expands and updates cross-references to guide readers quickly and easily.

Influential writers and editors rely on DMLU daily. Charles Alan Wright, for example, says, "I consult Garner regularly. He offers authoritative guidance on many matters of usage that are unique to legal writing....Garner is almost always pithy; he is often witty. Any lawyer, no matter how expert on words and language, is sure to learn from Garner's fine book." And the editors of Harvard Law Review have found it essential: "In a work worthy of comparison to Fowler's Dictionary of Modern English Usage, Mr. Garner...sets forth an authoritative guide to American legal usage and style. All legal writers will find it an invaluable help; many law review editors will find it a source of delight. Don't confront your editor without it."

Features:

-- Functions both as a style guide and as a law dictionary

-- Guides writers to distinguish between true terms of law and mere jargon

-- Illustrates recommended forms of expression as well as common blunders with thousands of quotations and citations

-- Explains the origins of expressions lawyers regularly use, such as Know all men by these presents, or party of the first part

-- Records and evaluates more than 100 twentieth-century neologisms, from conclusory to farminor, from Mirandize to representee

-- Distinguishes American from British usage and refers to current practice among Australian, Canadian, and Scottish legal writers

-- Solves editorial problems by dealing with practical writing issues

-- Offers wit and erudition reminiscent of H.W. Fowler, author of the first so-called usage dictionary.

In short, in its Second Edition DMLU remains, as one reviewer hailed it in 1987, "truly unique in the literature of law." It is an essential resource for practicing lawyers, scholars of the law, and libraries of all sizes and types. ... Read more

5-0 out of 5 stars Can't Live Without It
As an editor of legal newsletters, I do not know what I would do without this absolutely necessary tool of the trade. Not only do I, a non-attorney, find it indispensible, but my colleagues who are members of the Bar are constantly borrowing my copy "just to check." And whatever they, or I, am checking--it's in there.

Garner has a way of condensing solid and often very intricate information into a few paragraphs so succinct, and so informative, that anyone can understand. When one is rushing against a deadline, editing for and about attorneys and the law, reaching for Garner often makes the difference.

I would give up my dictionary before I would part with this book, and I cannot recommend it highly enough. Garner has earned his place in the annals of legal writing and editing, and I hold him--and this book--in the highest esteem.

5-0 out of 5 stars An essential companion
A J.D., admission to the bar, and this book should be the three requirements for any individual to practice law. The title, "A Dictionary of Modern Legal Usage," is absolutely appropriate in that this book does not merely serve as an alternative to Black's to find the definition of a word or phrase. Rather, the book's emphasis is on appropriate usage. It is an enjoyable enough read that one might end up reading it from cover to cover if one isn't careful. I recommend it highly.

5-0 out of 5 stars The indispensable authority.
If you have a question about a legal word or about legal writing, look it up here. You'll find the answer, and you're also likely to find a lively and intelligent discussion on the point. But the best thing about DMLU2 is that it's correct. So use it for back-up when you need to be right. Every lawyer should have it.

5-0 out of 5 stars A must have for a student going to law school or a lawyer!
If one has the propensity or will to go to law school or is already a legal professional by profession then one should own this book in question, i.e., A Dictionary of Modern Legal Usage by Bryan A. Garner. One will soon find that this is an indespenseable tool which can be used to get the real meaning and usage for terms such as avulsion, award over and other terms that can be said to be legal lingo. The print is very clear and easy to read and the font is very easy on the eye. 65 Dollars is also quite a bargain when one considers the wealth of information that is presented in this one volume guide to modern legal usage. Very much Recommended.

5-0 out of 5 stars A reference that every lawyer should own -- and use.
Garner should be carried shoulder-high for this work. Much expanded beyond the first edition, it provides intelligent, informed guidance on both individual terms and general topics. What does it really mean to "beg the question"? Is "struck" preferable to "stricken"? What's the plural of "cestui que trust"? Garner does not simply give thumbs up or down; he explains the pros and cons of various usages, with an outlook that is literate and, above all, practical. Time after time I find that he has anticipated my questions and has answered them with just the right level of detail. ... Read more

This new dictionary provides a ready reference to essential terms and phrases used in all areas of law and business, including accounting, banking, civil law, civil procedure, contracts, corporate law, criminal law, criminal procedure, economics, intellectual property, labor law, real property, secured transactions, securities law, and torts. Written by an American attorney who is also an accredited translator, it provides complete coverage of terminology used in all Spanish-speaking countries, not just those countries where the other bilingual dictionaries on the market were written (i.e., Spain and Argentina). Accordingly, it is the only source for translations of terms that are unique to countries such as Colombia, Peru and Venezuela. The dictionary was thoroughly researched using original documents and monolingual dictionaries from the Spanish-speaking various countries and is thus authoritative and up-to-date. No lawyer or translator who works with Spanish legal and business documents can afford to be without it. ... Read more

5-0 out of 5 stars A dictionary like none other
I have used many Spanish-English legal dictionaries, but never have I found a book as useful as this one. Unlike the others, this dictionary includes explanations of many of the terms. If you're trying to figure what the difference is between an "embargo" and "secuestro," this book will explain it to you. If you're translating a "sentencia," you can look up that word in this dictionary, and it tells you about the four parts of a "sentencia" in a Spanish-speaking country. The other thing that is completely different about this book is that it contains terms from Guatemala, Peru, El Salvador, Bolivia, Chile, etc.--in other words, terms from all the countries that a dictionary from Argentina is not going to include (because they don't turn up in Argentine documents). In short, if I could only have ONE Spanish-English legal dictionary, this would be it!

5-0 out of 5 stars An Excellent Resource for Translating Spanish Legal Document
Tom West brings his expertise as a translator and attorney together to produce this excellent resource. Focussing on difficult legal and commercial terminology, his translations are accurate and correspond to actual usage among the U.S. legal community. I have found this dictionary particularly useful for translating jurisprudence and court decisions from Spanish to English. Mr. West identifies several country-specific terms. In addition, he often includes information on the type of context in which a term is used and/or gives an explanation of the legal concept behind the term. For example, the dictionary explains the difference between "good offices" and "mediation." So if you're trying to understand what a "decreto exento" means in Chile or what the term "decretar pruebas" means in Colombia, or if you're looking for a way to say "casación" in English and make sense to an American lawyer, this is the book that has the answers. Mr. West's dictionary is designed as a supplementary reference work for high-level, experienced legal translators in the Spanish to English combination. If you fit that category, his book is a real treasure.

1-0 out of 5 stars A waste of your money
This book is most useful if you are only looking to translate Spanish to English (about 225 pages). But do not get this book if you need English to Spanish translations (about 70 pages). This section is very limited. And I mean VERY limited. Most of the legal terms, even the most basic ones, weren't there, and I did find them in my regular English/Spanish dictionary.

I wish I had read the review from St. George before purchasing it. But I got this book a while ago, and after repeated, frustraing times looking up words I decided to go ahead and write a review.

2-0 out of 5 stars A very limited Spanish / English Dictionary
As you will note from the reviews that follow, this is a good Spanish - English Dictionary IF YOU ARE TRANSLATING FROM SPANISH INTO ENGLISH; it is not so good if you are translating from English to Spanish. Being a lawyer who speaks Spanish, I occasionaly have Spanish clients, and I need to come up with a Spanish word for a legal term I am aware of in English. I read the other reviews before purchasing this Spanish-English dictionary. I, finally, put forth the $75 to purchase it. When I received it, I decided to look up the Spanish word for "Judge" - to see if I was using the right term (is it "Juez" or "Juzgado"). I turned to the page for "J" and, low and behold, THERE WAS NO WORD FOR "JUDGE"! IT WASN'T EVEN LISTED! I turned to the Spanish section and found "Juez" - which was listed as "Judge"; also, I found "Juzgador" - which was listed as "Judge." (I discovered that "Jugado" is "Court" - rather than "Judge" as I had presumed.) I realized that this book wasn't going to work for me - having to translate FROM English INTO Spanish. On the other hand, I recently had to translate a Spanish Adoption record into English. There were Spanish legal phrases which, after several hours of using my regular (Non-legal) Spanish/English dictionary, I was able to deduce the equivilant legal phrases in English. Well, this dictionary probably would have been useful. As the author notes in his preface: "Because my research focused on Spanish-language materials, my original intent had been not to include an English-to-Spanish section at all." He, then, notes that he decided to include a (VERY LIMITED and relatively small) English-to-Spanish section. So, if you are translating FROM Spanish INTO English, this dictionary will probably be useful; however, if you are trying to translate FROM English INTO Spanish, I suggest you try another Spanish/English Dictionary. (I'll probably return this one and get my $75 back.)

5-0 out of 5 stars A desktop companion for transnational practice
Mr. West's Spanish-English Dictionary of Law and Business lives up to the promise on the dust jacket. It IS a must for any lawyer or translator who works with legal and business documents in Spanish. In carefully chosen entries and bracketed explanatory notes Mr. West anticipates potential snares in usage and cultural anomalies-between civil and common law and among civil law jurisdictions. Having tested it in my transnational practice in Mexico, I found it a more current reference than my dog-eared Sell's COMPREHENSIVE SPECIALIST'S DICTIONARY (1957) and more thorough than any of my Spanish-English legal dictionaries that are still in print. It beat out Robb's DICCIONARIO DE TÉRMINOS LEGALES (1991) for the spot on my credenza between and the DICCIONARIO JURÍDICO MEXICANO (1992) and my Bryan A. Garner collection. ... Read more

Book Description

Good legal writing wins court cases. It its first edition, The Winning Brief proved that the key to writing well is understanding the judicial readership. Now, in a revised and updated version of this modern classic, Bryan A. Garner explains the art of effective writing in 100 concise, practical, and easy-to-use sections. Covering everything from the rules for planning and organizing a brief to openers that can capture a judge's attention from the first few words, these tips add up to the most compelling, orderly, and visually appealing brief that an advocate can present. In Garner's view, good writing is good thinking put to paper. 'Never write a sentence that you couldn't easily speak,' he warns-and demonstrates how to do just that. Beginning each tip with a set of quotable quotes from experts, he then gives masterly advice on building sound paragraphs, drafting crisp sentences, choosing the best words ('Strike pursuant to from your vocabulary.'), quoting authority, citing sources, and designing a document that looks as impressive as it reads. Throughout, he shows how to edit for maximal impact, using vivid before-and-after examples that apply the basics of rhetoric to persuasive writing. Filled with examples of good and bad writing from actual briefs filed in courts of all types, The Winning Brief also covers the new appellate rules for preparing federal briefs. Constantly collecting material from his seminars and polling judges for their preferences, the second edition delivers the same solid guidelines with even more supporting evidence. To the ordinary person, who hasn't spent three years grinding through law school, legalese gets its point across as clearly and effortlessly as a dose of ancient Greek. Right up there with medical lingo, legal jargon confuses and alienates folks, makes them feel stupid and ill at ease. A translation or two, however, can go a long way toward clearing the legal air. With concise and sensible definitions, Merriam Webster's Dictionary of Law converts a lease, will, or summons into standard English, and removes the intimidation factor from what is, basically, an effort at reliable communication. Been wondering about tortfeasors and arrears, peculation and naked promises, John Doe summonses and Terry stops? From ABA (American Bar Association) to Zone of Privacy ("an area or aspect of life that is held to be protected from intrusion by a specific constitutional guarantee"), the dictionary defines and explains 10,000 legal terms, allowing a ready grasp of laws, statutes, and legal procedures to anyone who knows how to crack open a dictionary.

Despite the title, the book is more than a mere dictionary. There's a chapter explaining the United States judicial system, a chapter discussing important legal cases, and another summarizing important laws. There's also a section on important legal agencies in the U.S., followed by the full Constitution of the United States, making this a useful family legal reference, adding clarity to news reports, assisting with homework assignments, simplifying potentially scary legal actions, and making government agencies, civil rights, and legal options less daunting and more accessible. --Stephanie Gold ... I found this book to be useful when looking for general terms. However, if you are searching for very specific terms used in the legal profession or more recent terminology used, then one may want to opt for something else.

3-0 out of 5 stars Spanish Law Dictionary/Diccionario De Terminos Juridicos
I was disappointed on this dictionary. As a translator, I thought it would be a helpful tool for handling legal texts, but found it very basic and way too expensive for what it offers. It was explained to me that the hardcover makes it so pricey. In that case, it's worth waiting for the paperback version. ... Read more
