5-0 out of 5 stars Business Law Explained for the Intelligent Layman
I was given this book for free by someone who had used it for a college course and didn't want it. I couldn't believe the person wanted to throw it away. This book tells all the basics of business law. If you don't know anything about business law, read it. It is a good book for beginners. I know I will keep it for a reference book for a long time. I am starting my own business and I refer to it all the time. Not only does the book tells just about everything you need to know about business law, it gives actual descriptions of court cases to illustrate the points of each section. A very good buy & an excellent reference book! ... Read more

Book Description

The unprecedented expansion in environmental regulation over the past thirty years--at all levels of government--signifies a transformation of our nation's laws that is both palpable and encouraging. Environmental laws now affect almost everything we do, from the cars we drive and the places we live to the air we breathe and the water we drink. But while enormous strides have been made since the 1970s, gaps in the coverage, implementation, and enforcement of the existing laws still leave much work to be done.

In The Making of Environmental Law, Richard J. Lazarus offers a new interpretation of the past three decades of this area of the law, examining the legal, political, cultural, and scientific factors that have shaped--and sometimes hindered--the creation of pollution controls and natural resource management laws. He argues that in the future, environmental law must forge a more nuanced understanding of the uncertainties and trade-offs, as well as the better-organized political opposition that currently dominates the federal government. Lazarus is especially well equipped to tell this story, given his active involvement in many of the most significant moments in the history of environmental law as a litigator for the Justice Department's Environment and Natural Resources Division, an assistant to the Solicitor General, and a member of advisory boards of the U.S. Environmental Protection Agency, the World Wildlife Fund, and the Environmental Defense Fund.

Ranging widely in his analysis, Lazarus not only explains why modern environmental law emerged when it did and how it has evolved, but also points to the ambiguities in our current situation. As the field of environmental law "grays" with middle age, Lazarus's discussions of its history, the lessons learned from past legal reforms, and the challenges facing future lawmakers are both timely and invigorating.

4-0 out of 5 stars astonishing
I go to Harvard law school and I have found this book to be helpful in my field of study. Although i also study criminal justice law I have now become interested in environmental and this book has been impressive. This book is a life saver. It was classy and sophisticated. Please go buy this and I hope to see some new challenging faces at Harvard. Thank you for taking the time to read this.

5-0 out of 5 stars This is an outstanding book.
I've used this book in two seated classes and one online course on environmental law. If you want a glorified HAZMAT course or have decided that the way our legal system actually operates doesn't matter, then look elsewhere. This is not a science book (nor should it be). If you want a text that students find easy to read and that provides comprehensive coverage of environmental law and our legal system, this is your book.

5-0 out of 5 stars An Outstanding Book!
I've used "Environmental Law" by Nancy K Kubasek and Gary S. Silverman in two seated classes and one online course. It is an outstanding text for describing the parameters of our legal system to students. Those to want a glorified HAZMAT approach to environmental law (or want to ignore the legal system) might not like the book. I love it.

2-0 out of 5 stars Limited value
The author of this books is an attorney who does a fairly good job with the big picture but not very well with the science. If you're only looking for a quick study of the structure of environmental law in the U.S., which is about one-third of this book, it's readable and informative. It also uses language and structure that's accessible for advanced high school and lower division college students in giving and overview of the U.S. legal and regulatory system for the environment. The author creates a good historical context for these discussions. However, the book begins to lose its polish when the author ventures into discussions of the science behind the law. I noted several points where the presentation of the science was clearly poorly informed (ozone and global warming, nuclear and alternative engery). If you're only looking for an general introduction to environmenal law, this book will get you started. But, if you want to get a good idea of the science that drives environmental law, keep looking. ... Read more

Book Description

Environmental law is now a substantial and complex subject. Clearly, much environmental law is in the form of public regulation designed to prevent, or at least reduce pollution at source. Nevertheless, from time to time accidents occur with devastating consequences for the environment and the private interests which vest in it. In Europe, the names `SEVESO' and `BRAER' are synonymous with catastrophic environmental disasters. In North America, the `EXXON VALDEZ' disaster achieved global notoriety as a symbol of modern industry's recklessness in its treatment of the environment. Cases of this nature have highlighted the impact of environmental damage on private interests and have focused attention on the law of tort in this context.By adopting a theoretical and comparative approach, the author has endeavoured to answer the basic question of whether, through increased protection of private interests, tort has the ability to provide a useful additional means of environmental protection. ... "...a valuable reference tool because it is easy to use, and includes clear, concise discussions." — Bowker's Legal Publishing Review

The transportation of hazardous materials anddisposal have become immense environmental concerns. As a result a number of government agencies have constructed regulation for manufacturers to follow, which are often confusing and written in complex legal terminologies. This new edition of a successful publication is designed to help professionals from all disciplines understand the national hazardous waste regulatory program. 4-0 out of 5 stars Bravo!
A great reference book for those needing to decipher hazardous waste regulatory jargon. I've wasted my money on other so-called interpretive guides, which merely summarized the law. Ho hum. Wagner's book goes much further to explain and decipher the regulations, not just the law. Very helpful!

5-0 out of 5 stars Finally, a book that fully and correctly explains RCRA!
A colleague shared this book with me to help explain some meaty aspect of RCRA. I finally understand what is required so that I can talk intelligently with the regulators. I subsequently went out and purchased my own copy. This book is great as a reference. I highly recommend you obtain a copy if you are as mystified by the RCRA regs as most of us are. ... Read more

5-0 out of 5 stars Best Textbook on International Environmental Law
As this book is 1550 pages long, I have not read the whole thing. But as a textbook and thanks to its clear structure it is possible to read parts of the book without getting lost. It is also useful to get an introduction into a specific topic on which one might do further research. Taken into account that this is a book for studying, it is almost fun to read. It is very comprehensive and covers not only the basics of environmental problems, and the international environmental law itself, but also a lot of cross cutting issues. The chosen excerpts are from the many different influential scholars and practitioners and fit very good into the particular sections. The book deals with the traditional views and the needed basic information on international environmental law. But it also points out alternative views and progressive developments in this area. I liked in particular the introductory chapters on environmental problems and their relation to philosophical, development and social issues. ... Read more

4-0 out of 5 stars Good book for mineral owners as well as students
The third edition of this book was very helpful, and also included more recent case law cites than the second edition. I would assume this it true with the fourth as well (and there have been quite a few post 1995 court cases affecting royalty payments among other things). John Lowe is a well-respected professor of oil and gas law and has written many papers as well as several books on the subject.I find his writing style easy to understand, even for a layman like myself.I also found it to be much more than a "nutshell" approach in that the explanations of complicated ideas are fairly complete in most cases. He even touches on the structure and content of oil and gas sales contracts near the end of the book, which I found helpful as well. ... Read more

Book Description

Violent conflict can spell catastrophe for developing countries and their neighbors, stunting and even reversing the course of economic growth. Recent World Bank research on the causes of conflict and civil war finds that the countries most likely to be blighted by conflict are those whose economies depend heavily on natural resources. Natural Resources and Violent Conflict: Options and Actions first explains the links between resource dependence conflict and then considers what can be done to help reduce the risk of civil war in these nations.

In this collection of previously unpublished essays by experts in the field, contributors consider the risks of corruption, secessionist movements, and rebel financing. They also consider the roles played by government, the development community, and the country’s population and propose an agenda for global action. Focusing on what we can do collectively to diminish the likelihood of civil war, contributors to this volume suggest practical approaches and policies that could be adopted by the international community—from financial and resource reporting procedures to commodity tracking systems and enforcement techniques, including sanctions, certification requirements, and aid conditionality.

A fascinating look at the results of important new World Bank research, this book represents an important addition to the dialogue on development ... Read more

5-0 out of 5 stars compliance handbook
For anyone whose job entails understanding environmental law, this book is essential. The authors cover a wide range of federal environmental law, from hazardous waste to endangered species, and they do it in a format that is easy to utilize.

Unlike many other handbooks, the authors clearly state their objectives in the first chapter, then proceed to carry out their plan. The book is organized into logical chapters with many divisions so not to overwhelm the reader. The writing style is clear and concise.

Admittedly, the authors explain the limitations of a book that only focuses on federal law, but there are plenty of state environmental law handbooks to fill any gaps.It is up to the user to find supplemental works that cover what this book does not.

All told, this book ought to be the standard in its field for years to come, at least until a new batch of environmental laws renders it obsolete. ... Read more

Although considerable progress has been made in improving environmental quality in parts of the United States, many localities have yet to meet federal air and water quality standards and many hazardous-waste sites remain to be cleaned up. At the international level, the U.S. and other countries continue to face critical environmental problems. As a contribution to the literature on public policy and to help educate students about natural resource issues, this book identifies the likely "hot spots" of environmental policy and presents alternative and often opposing points of view on the major controversies that are likely to be with us well into the next century. Among the topics covered are comparative risk assessment; market incentives in environmental regulation; environmental justice; public versus private management of public lands; international trade and sustainable development; and the relationship between national security and environmental protection. ... Book Description

Since the 1970s, the Endangered Species Act (ESA), by virtue of its regulatory impact, has been a frequent subject of policy analysis. In this comprehensive history and critique of the ESA, Brian Czech and Paul R. Krausman incorporate the new model of policy design theory to frame a larger discussion about conservation biology and American democracy.

Czech and Krausman provide a historical background of endangered species policy that integrates natural history, socioeconomic trends, political movements, and professional developments. Outlining the controversies surrounding the ESA, they find a connection between challenges to species conservation and challenges to democracy. After an assessment of ESA analyses that have been performed from traditional perspectives, they engage policy design theory to review the structural logic of the ESA, analyzing each clause of the legislation for its application of the fundamental elements of democracy. To address the technical legitimacy of ESA, they propose two new genetic considerations—functional genome size and molecular clock speed—to supplement phylogenetic distinctiveness as criteria with which to prioritize species for conservation. Next, they systematically describe the socioeconomic context of ESA by assessing and classifying the causes of species endangerment.

A hybrid of policy analysis and ecological assessment, The Endangered Species Act: History, Conservation Biology, and Public Policy will appeal to scholars and students in the fields of natural resource policy and law, conservation biology, political science, wildlife ecology, and environmental history, and to professionals at agencies involved in wildlife conservation. ... Book Description

A 1999 Choice Outstanding Academic Title

As the twentieth century draws to a close, the earth's physical and biological systems are under unprecedented strain. In many ways, all serious environmental threats are now international in scope, since nearly all forms of pollution, use of resources, and destabilization of natural ecosystems have implications for the sustainability of life as we know it.

The consumption of resources by one country or group of people ultimately affects other-and much larger-sections of the human population, including all those in future generations. Over the past three decades, the nations of the world have begun to deal on a global scale with many environmental threats, particularly through efforts to devise comprehensive agendas for safeguarding the environment while also promoting economic development.

The Global Environment, a timely new collection of essays, analyzes and assesses the state of international institutions, regimes, laws, and policies for the protection of the global environment at the close of the twentieth century. All essays have been written expressly for this volume or were adapted for firsttime publication in it. A distinguished international cast of contributors includes leading American and European academic experts on environmental politics, international law, and sustainable development policies. While providing a historical overview of the development of global and regional organizations and treaty agreements since World War II, the book focuses on implementation of "sustainable development" principles adopted at the United Nations Conference on Environment and Development in Rio de Janeiro in 1992.

An introductory chapter written by Norman J. Vig explains key terms and concepts, and summarizes each section of the text. Separate chapters cover the role of intergovernmental and nongovernmental organizations, the changing nature of international law, the worldwide implementation of Agenda 21 for carrying out sustainable development globally, the environmental consequences of international trade agreements, and negotiations leading to the historic Kyoto Protocol on climate change signed in December 1997.

Four case studies examine sustainable development policies and controversial development projects within individual states that have significant international repercussions. From path-breaking national environmental planning in the Netherlands . . . to questions about democracy, human rights, and the future of energy development raised by the construction of the Three Gorges Dam in China and the Temelin Nuclear Power Plant in the Czech Republic . . . to the difficulties of implementing international environmental norms in developing countries as illustrated by the example of mining regulation in Indonesia, students will see the relationships between national, regional, and global levels of environmental policy.

The Global Environment may be used as a companion volume to Environmental Policy in the 1990s, edited by Norman J. Vig and Michael E. Kraft, a new fourth edition of which will be published by CQ Press in early August as Environmental Policy: New Directions for the Twenty-first Century. ... Read more
