I'm a law student at a Chicago-area law school without a business background. I was completely freaked about taking Business Associations, but felt compelled because "Corporations" is on the bar exam. Well, about a week into the class I bought "Corp Fin in a Nutshell." Not only did it cover most (but not all) of the major topics in a Bus. Assoc. course, but it provided user-friendly background info that helped me really understand what was going on. I did so well in Bus. Assoc that I felt confident enough to take the Corp Fin class this semester, which I just finished. Just found out that I aced that class too in large part thanks to Haas' book. My first Garner book was "The Winning Brief," purchased as I was preparing for an ultimately successful fight against a speeding ticket, and I was instantly taken by his clear and informative style.

This book continues that trend. Garner is an exceptional writer, and even the best of writers, legal or otherwise, can learn a great deal from this book.

Where would I be without this book? Prior to law school I purchased this book. During my first year I had very little time to read it, but I tried to pick up bits and pieces where I could, where relevant. Prior to the traditional second year, law students compete for spots on the law review and other journals that may be published out of their schools. Prior to sitting down to consume my law review packet, I did my best to digest all I could from Brian Garner's outstanding brief legal writing "Bible," as I now refer to it. To make an already long story shorter, I made Iowa Law Review and now carry this book with me whenever I know I'm going to be required to do legal writing or editing. This semester I am a federal law clerk intern, and I've already used the book countless times to check my own writing style against seasoned practitioners and law clerks alike. Next to my bluebook, Garner's Elements of Legal Style is like my watch - I can't imagine surviving life without it.

4-0 out of 5 stars A "Must Have" for Anyone Engaged in Legal Writing
Despite the fact that many attorneys spend much of their time writing motions, briefs, memos and such with the intent of writing clearly and persuasively, most attorneys fail miserably at doing so. Many judges, the very people the attorneys are attempting to persuade complain of how terribly most attorneys write.

Now we have Bryan Garner to the rescue. If you don't know about Bryan, he is one of the preeminent legal scholars on the subject of writing clearly and persuasively. Bryan helps attorneys cut through the clutter of legalese, organize their arguments, and, ultimately, draft documents that often will win their argument solely on the basis of the fact that the Judge can at least read and understand the message.

Law students can also benefit from the information found in this book. I would even recommend it for the average layperson who wishes to represent their self in court or who simply wants to write more clearly and directly. Every lawyer should have this book on their shelf and follow its advice religiously. This book may very well be the "bible" of legal writing.

This review is of the Second Edition, published in 2002.

This book takes an intelligent, thoughtful, and somewhat scholarly approach to legal-writing style, yet it is still readable and practical. Garner presents good writing advice, with examples of how to do it taken from the great legal writers: Holmes, Cardozo, Llewellyn, and others.

And the coverage is broad: from punctuation to citation; from commonly-misused words to rhetorical devices for persuasion. The book covers enough basics to reward the novice, but it can take the experienced writer farther than other legal-writing books.

I had a dream when I was younger to be a Lawyer practicing Corporate Law or IT-based law. That dream never came true because now I'm an IT manager, but the fire was stoked when I picked up this book to review for one of my Masters courses. The book give you a clear understanding of legal terms, the trend with a focus on Internet Law, and how businesses will need to prepare themselves for the future precidence setting rulings to come. You don't have to be a legal geek to appreciate this work. Even outside of my scholastic requirement for getting this book I think I would have enjoyed it on it's own. It has indeed sparked a desire to search for more books on the subject.

This 12 chapter book is intended as a college text for business majors. However, it also deserves a place on the working professional's bookshelf, and is suited to both business and IT professionals.

Highlights: It's an up-to-date text that addresses the full range of topics from the contemporary legal environment defined and changed by the internet, to business agreements. The chapters on contract law, privacy and liability are essential reading for anyone involved in e-commerce, either as a business process owner or as an IT professional who is responsible for online content.

The first seven chapters are my favorite because they covered information that is of particular interest to business and IT professionals. Chapter 1 covers the legal landscape of e-commerce issues, then segues into three chapters on contract law, present and future issues of contract law that are specific to e-commerce, and contracting and licensing software. These chapters realistically address real issues and challenges. These chapters build the foundation for the next chapters that cover torts in general, and cyber torts in particular, and liability issues (often overlooked, but a all-too-real exposure).

Chapters 8 through 10 cover intellectual property in great detail. This topic is an inescapable reality of doing business over the internet, and is one in which the legal issues are still evolving. I recommend that anyone who focuses on this aspect of law also read Bill Zoellick's excellent book, CyberRegs: A Business Guide to Web Property, Privacy, and Patents. Chapter 11 is a brief examination of business organization that can be glossed over, but the final chapter, 12, on cyber companies and internet agreements is an essential chapter that is filled with invaluable facts and advice.

Don't let the fact that this is a college text deter you from purchasing this book. It is an excellent deskside reference that will guide you through real life issues. ... Read more

"Good luck," my employer wished as he handed me a plane ticket and a tome of a background packet. I was leaving on a critical six-week business trip to an alien state in the midwest. No problem - except that five days prior the law review had accepted me as one of three evening division 2Ls for candidacy and my first case abstracts were due in twenty days. Hmmm . . .

From my hotel room, I scanned, identified, analyzed, condensed, reviewed, and rewrote the abstracts. Then did it again. And again. And again. But I was missing something. I was missing that "oomph" that propels a reader when reading legal material. And I didn't know what to do.

I decided to take a "creative" break down at the local (bookstore). Of course, I immediately gravitated to the law section of the store and, before you could say "double espresso, please," I had found it! Burton's Legal Thesaurus.

I opened the pages and my heart fluttered. Over 5,000 entries, legal synonyms for any legal term that came to mind, definitions, an overview of federal "plain language" requirements, associated legal concepts, and the list goes on! I wiped away a tear.

I rushed back to my hotel room and my fingers began flying over the laptop. My abstracts sang with power and precision! I could feel the reader compelled - nay, helpless - to turn the page! Burton's Legal Thesaurus had saved the day! I was now a jurisprudence scholar!

Eh, not really. But it really helped out when I didn't have access to my usual materials. However, one thing of which I can assure you, I'll be using this thesaurus for the rest of my career. If you've ever tried to write a legal document with a conventional thesaurus, you've probably felt the same way I did - close, but not close enough. But where do I find "close enough"? Read some more cases? Subscribe to a half dozen law journals? Hang out with the professors? This book definitely dispenses with that problem. You'll find everything you need to write a work filled with persuasion and vigor contained within its pages. If you're not that creative with legal lingo (as I, obviously, am not), you need to order it now. Frankly, you're putting yourself at a serious disadvantage if you don't.

I have found that at this stage in my career, (1993 graduate) I really no longer have any need for looking up the definitions of legal words. I pretty much know the definition of most legal words, certainly all of the ones in my field. However, whether I am writing a Registration Statement, a Coverage Letter or even just a Memo to File, I constantly find myself in search of just the right word which accurately describes the point I am trying to communicate. Other times I might be trying to figuring out a new way to reiterated the same point in a document without sounding repetitive. Especially now with the SEC's new "Plain English Rules" in effect, attorneys are required to relay information to investors in fewer pages, while making the information easier for investors to understand. To put it bluntly, I find Burton's Legal Thesaurus to be an indispensable tool in the lawyers arsenal. No lawyer, paralegal, law student, law professor or judge should be without one.

It is an effective tool for identifying legal synonyms and related terms. Because of the shift from arcane legal writing to plain language, legal writers will find this source to be useful in writing clear and concise legal documents. It provides alternative or similar terms that will aid in researching in electronic sources. The format of the book is excellent; it has an index which allows you to cross-reference terms to the main entry which provides the definition of a term as well as additional information.

Having represented many people in their appeal process for disability benefits for the past 13 years, I have found that understanding the Administration's maze of regulations is full time effort. After a careful review of this book, it is my opinion that it will provide invaluable information for a newcomer to Social Security Representation as well as others with more experience. Wolf and Prozcek did a very good job and find myself referring to this book several times each week,to make certain that I did not leave "a stone un-turned'. It is my understanding that Wolfe is an Administrative Law Judge(ALJ) and Mrs. Proszek was a senior staff attorney with the Office of Hearings and Appeals-SSA, which adds to the credibility of this book. They write the decisions. Therefore, they covered in the book exactly what they would expect of a representative to provide for there client during the appeal process and at a hearing. It is a prudent practice to fully develop your case before you step in the hearing room, follow the steps in the book and you will make a better impression on the ALJ and provide your best effort for your client. In addition to being an excellent resource for small business owners, this book is recommended as a preparation for the CLEP Business Law examination (3 lower-level college credits) by a number of people. I second that opinion, especially if you are looking to hit the higher percentiles.

This isn't a dry academic text, but an easy to read text that covers the basics with a minimum of handholding. Hardwicke presents the critical information that managers need to know, in a down to earth book.

Highly recommended for CLEP or DANTES candidates.

I bought this book to study for the CLEP Business Law I exam. I realized I could also use it for the Dantes Business Law II exam. I passed both, and am keeping it for a handy desk reference.

I passed the Introductory Business Law CLEP using this book, which I had previously failed using Orr's Review for the CLEP. The Special Topics section included information needed to pass that was not even mentioned in Orr's book. Also included, are examples that provide a much clearer understanding of the topics and how to apply them. There is a lot of material to digest, so give yourself a good week to study from this book. Each chapter includes boxes titled YOU SHOULD REMEMBER, these are key, at a minimum you should be knowledgable on these points. Good Luck.

I bought this book as recommended to study for the Introduction to Business Law CLEP. It is a good tool for that purpose. I, however, am a person that wants to get A's on tests, except when it is pass or fail (then I just want to pass). This book probably gives all the information you need for the CLEP, but I just skimmed the parts that looked the most important. All of the information I read seemed to be covered in the much simpler book CLEP Introductory Business Law Review published by Comex.
I ended up barely passing my test with a 56, but I think I could have done the same without Barron's Review.
My advice, if you want to really be prepared, buy this book and read it after the CLEP Review by Comex. I would have absorbed the information a lot better if I had read it second. Also make sure you stay awake while you are reading it. It was not hard to read in terms of vocabulary, but I found it was very boring.
If you do not buy this book, and just read the Comex you are taking a risk, but the time saved may be worth it. This CLEP really is a lot harder than the Priciples of Management and other tests I have taken. That is the same thing other reviewers have said, and you should believe it.

This is an excellent compendium of the major subject areas
taught in a business law course. The book has a fair coverage
of legal rights, government regulatory processes,contracts,
personal property, sales, commercial paper, creditor rights,
agency and employment, partnerships, corporations, real property,
the Uniform Commercial Code and an index. The work presents
typical case studies utilizing the classic factual patterns and
the decision. There are important case studies contained
for student homework assignments and class participation.
The work is edited by some important CPA Review giants like
Dr. Fox -famous for his rendition of the CPA law review.
It is a worthy purchase for anyone studying business law or
sitting for the CPA Examination.

The work is easy to read considering the complexity of some

If you are an aspiring music artist or a personal manager, you will inevitably come into contractual situations that require the employment of an entertainment attorney. This book will help you to understand some of the basic clauses that are found in most of the common industry contracts; however, for the true industry novice, much of the information contained here will go over your head. It does provide shrewd, practical advice on how to approach legal situations in a general sense, but its effectiveness will be best maximized when used to understand and improve communications with your attorney about whatever legal situation you are considering or negotiating.

I've taken the Marketing and Management CLEP Exams, and they were much easier than this. I don't know if I can blame it on the book, but many of the questions on the exam were not covered. I, however, do think it would be worth your time to buy the book, read it over a couple times, and take the test. I needed a 51 and got 53.

I bought the book 3 months ago, took the test this month and got 60, passed the test. That was the 3rd time I took the test.

Before the 1st time I took the test, I only had "Clep Test-Intruduction to Business Law"-a pink color book from Clep center with sample questions only,no any explanation. I got 48.

Before the 2nd time I took the test, I read about 2 text books and wasted too much time, only got 43.

Before the 3rd time I took the test, I read this book and that pink color book thoroughly, I got 60.

I want to thank Mr. Thomas Orr. This is a very helpful book.

I failed the CLEP using this book. There was way too much information missing. Topics on Employment Law and Environmental Law were not even covered. I studied from Barron's Business Law before taking the test again, and passed. Barron's provides very useful examples and YOU SHOULD REMEMBER boxes that are very applicable to the test. You need to study more for this CLEP then the others. This was the hardest CLEP I have taken. Good Luck

No, the book is not perfect. Comex's review for Principles of Management it outstanding, giving all the information needed. This book is only half that wonderful. Like everyone else said, it only covers half of the information.
I passed the Principles of Management with a 72. I read this book 1 1/2 times, and sort of skimmed the Barron's Review and got a 56 on the Business Law. Same amount of prep time, but a much lower grade. This CLEP really is harder, I think because the study guides are not as good.
My advice depends on how much of a risk you want to take. I think I would have still got a 56 without the Barron's Review. If you want to pass the first time and be thoroughly prepared, read this book first then carefully read the Barron's Review.
If you do not want to over study and do not mind the minimal grade, try just using this book. It would certainly be faster. If you do that really know everything this book covers, and be prepared to have to take it again.

This book was absolutely worthless! As a conservative estimate, this book may have covered one-fifth of the test questions! I have taken two other CLEP exams and passed them with 17 and 19 points higher than required (using only one book). I failed this exam by five points.
