Book Description

Legal problems can be very costly to media producers.Lawyers and court fees, coupled with the loss of work time, can lead to bankruptcy.Media Law for Producers cuts through the legalese and illustrates legal issues to help producers recognize the legal questions that can come up during production, from performer contracts through copyright registrations.

Beginning with an overview of what is media law, Media Law for Producers examines the court system and how media law is made: litigation and arbitration; contracts (sample production contracts are included); copyright, trademarks, and patents; permits, releases, and insurance; privacy, libel, and defamation; licensing music; working with and without unions; royalties and residuals; protecting your finished production; and special considerations for productions that will be broadcast.

Contracts are a very important part of this book and Miller explains the reasons behind the necessary components of several types of media contracts. Through clear explanations and examples, Media Law for Producers completely covers what producers need to be aware of to avoid legal trouble.

Philip Miller is an attorney in the Century City (Los Angeles) office of Irell & Manella LLP, where he specializes in entertainment and intellectual property law.He writes often on the subject of media and technology law and policy.

· A useful, practical guide for the active producer
· Completely revised and updated to include a new chapter on Interactive Media

Book Description

With the development of technology such as films, sound recordings and the Internet, performers have lost control over the exploitation of their performances. The perceived need to protect performers on an international basis - that is, in states in which they are foreigners - has led to provisions being included in three international instruments (the Rome Convention (1961), TRIPS (1994), and the WIPO Performances and Phonograms Treaty (1996)) that together form an international system of performers' rights.

The scope of performers' rights protection is a contentious issue at the international level. The WIPO Performances and Phonograms Treaty nearly foundered on the issue of the level of protection to be granted to performers whose performances are exploited in films, videos and other audiovisual media; and a Diplomatic Conference held in Geneva in December 2000 failed to reach agreement on the terms of an international instrument protecting such performers.

This is the first book in English to provide a comparative analysis of the protection afforded to performers in the international instruments. Although the focus is on establishing whether the international instruments provide an appropriate system of protection, attention is given to the key underlying issues: from whom or from what do performers need protection; can protection for performers be justified; what is a performance? Where appropriate, examples of domestic legislation and cases are drawn from the UK and other common law jurisdictions.

This book will be of value to practitioners, academics and to government officials interested in determining the future shape of domestic law. It will also provide interesting and valuable assistance to officials in performers' and producers' unions and guilds. ... Read more

Book Description

Even though the First Amendment of the U.S. Constitution grants freedom of speech and freedom of the press, laws and regulations governing media frequently evolve as the media themselves do. As a result, it is often a challenge to keep pace with new laws and regulations.

Electronic Media Law is a comprehensive, up-to-date textbook on the constantly changing and often complex world of electronic media law. Author Roger L. Sadler examines the laws, regulations, and court rulings affecting broadcasting, cable, satellite, and cyberspace. The book also looks at cases from the print media and general First Amendment law, because they often contain important concepts that are relevant to the electronic media.

Electronic Media Law
is written for mass media students, not for future lawyers, so the text is straightforward and explains "legalese." The author covers First Amendment law, political broadcasting rules, broadcast content regulations, FCC rules for station operations, cable regulation, media ownership rules, media liability lawsuits, intrusive newsgathering methods, media restrictions during wartime, libel, privacy, copyright, advertising law, freedom of information, cameras in the court, and privilege.

Key Features

  • Provides an easy-to-use format of chapter categories and sections that facilitate research on individual topics
  • Frequently Asked Questions highlight important points from cases
  • Explains complex, legal concepts in basic terms that give students the foundation for further studies in electronic media law

Electronic Media Law provides an understanding of the First Amendment and the American legal system with an emphasis on the electronic media. It is an excellent textbook for undergraduate and graduate students studying broadcast law and media law.
