    Book Description

A family's wealth consists primarily of human capital, meaning, all of the individuals who make up the family, and intellectual capital, meaning, the sum of what each individual member knows, and consists only secondarily of its financial capital. That compelling premise forms the core of Family Wealth—Keeping It in the Family.

This classic treatise has been updated and expanded to include new essays that challenge conventional notions of wealth and that offer guidelines for conserving family assets in the broadest sense: not for just one or two generations but for hundreds of years—and not giving truth to the saying "shirtsleeves to shirtsleeves in three generations."

James Hughes, a prominent attorney and estate planner, teaches how successful long-term wealth preservation requires the creation and maintenance of a system of governance and joint decision making. Filled with inspiration and guidance, Family Wealth enunciates tested principles and practices for preserving wealth and keeping it in the family. ... Read more

4-0 out of 5 stars Insightful!
Reading James E. Hughes Jr.'s book is like sitting down in an easy chair with brass rivets gleaming in burgundy leather, in a trusted old family friend's parlor, to obtain a kindly word of advice. You can almost smell the pipe tobacco and taste the brandy as you read. Hughes gently and wisely guides people who want to preserve their family's wealth on how to think beyond the current fiscal year. This book is genuine and straightforward, with insights gained over many years. Hughes covers creating a family mission statement, instituting a family bank or private trust company, mentoring the next generation, family governance, philanthropy and much more. His most important contribution, however, is the perspective he offers on the human side of the equation. Even the richest families are doomed to squander their inheritances, he cautions, unless they recognize the importance of the intellectual and human development of their family members. We highly recommends this book of sage advice to anyone who hopes to keep it all in the family.

5-0 out of 5 stars A great addition to my bookshelf
I've read a lot of books and recommended them to my friends and family. This one, I bought for my partners and family. As someone who deals daily with great family wealth, it is invaluable to learn from the experiences of others. There is a wealth of ideas in this book, not just for those with great financial assets, but for those families with great human capital. I would recommend it for anyone who deals with family wealth: attorneys, CPA's, trust officers, and members of families who want to preserve their family wealth (financial, human or intellectual capital).

5-0 out of 5 stars A New Paradigm For Wealth Preserving
As a great philosopher once said "I am not ashamed to say that I have learned the good news of the truth and am called to proclaim it to others." The truth is Family Wealth: Keeping It In The Family, is the clear result of the author's extensive discernment and constitutes that rare slice of my profession which rises to the level of a ministry. The beauty of this work lies in the author's ability to state concepts with such simplicity and flow, the reader may be lead to conclude "these insights are so patently obvious I should have discovered them myself." Many of us in the estate planning profession, however, have not previously done so. Having invested 20 years in this profession I can attest that many people with reasonable career abilities can accumulate considerable sums of wealth. Moreover, a reasonably competent estate planning attorney can draft the business and estate planning documents to pass that wealth from one generation to the next. Yet after reading Mr. Hughes' book twice (and garnering increasing insights and applications after each journey) it is manifest that merely fulfilling the professional expectations taught in law school will henceforth be insufficient to deal with the interpersonal dynamics and relationship issues which must be addressed in order to wealth preserve. Moreover, this process must be rekindled and nurtured at each generation level. I now understand that to be a truly excellent estate planner, the issues in this book must be addressed by estate planner and client. Your clients need not have the wealth of a Warren Buffett or Bill Gates to benefit from the wisdom of this book and I hope it will raise the standards for the profession as a whole as it did for me.

5-0 out of 5 stars Comprehensive and clear
This book is essential reading for anyone involved in internal audits per Sarbanes-Oxley, including auditing professionals and senior management whose business or technical domains are affected (i.e., all senior managers).

The focus is on auditing from the practitioner's point of view, and Chapter 2 shines because it summarizes SOA and how it affects internal audit as a function and as a practice. This material encompasses relationships with external auditors and with the audit committee, which are important parts of SOA. A further tie to the audit committee is given in detail in Chapter 3.

Chapter 5, 'COSO, Section 404, and Control Self-Assessments' is the heart of this book in many respects. However, as an IT consultant I found Chapters 6, 7 and 9 more aligned to what I do - and the reason why I cited the audience of this book as wider than auditing practitioners. For example, the inclusion of CobiT (Control Objectives for IT) in Chapter 6, Disaster Recovery and Continuity Planning (Chapter 7) and Enterprise Risk Management, Privacy, and Other Legislative Initiatives (Chapter 9) are directly or indirectly related to IT, and the information I gleaned from those chapters helped to place SOA within the context of my profession's support requirements and IT auditing. I was also surprised and gratified to find ITIL best practices, which is an international standard for IT infrastructure management, including service delivery and service support. Again, this information shows how far reaching SOA is, and the need for all managers to fully understand their roles and how SOA will affect the way they operate and manage their functional areas.

Of course, for professional auditors, the chapters on Internal Audit Fraud Detection and Prevention (8), Rules and Procedures for Internal Auditors Worldwide (10), and Continuous Assurance Auditing Future Directions (11) round out this comprehensive book. As a non-practitioner I found it to be clearly written and, in many respects, enlightening. The breadth of topics and the depth into which they are delved is impressive. ... Read more

5-0 out of 5 stars Excellent
The main idea behind all books like this is that you MUST start some kind of business (part time, at home, whatever) to take advantage of some amazing tax laws. Making that first move is probably the hardest step for most people. Don't expect a motivational pep talk here. Think of it like this: What would you give for a 10% raise? 20%? 30%? You can save that much in taxes if you take the small step of creating a business.

Once you are ready to take that step, this book is wonderful. Other books talk about the same stuff, but this one is easy to read, well organized, and best of all, the author cites everything to the IRS code or case law. That is important since many financial gurus (think Rich Dad series) give advice that is plainly wrong or sometimes even illegal. This book is 100% legit.

I was concerned when I heard the author was associated with Tony Robbins, but Mr. Botkin makes no attempt to sell or promote any product in this book.

Read this book, save lots of money. Good luck.

4-0 out of 5 stars Interesting book with a very different approach
I would have given it 4 and 1/2 stars but that wasn't an option. The only reason that I didn't give it 5 stars was that the book deals with small and home bases business issues and for real estate owners and investors. I am retired and thus, could only benefit from the real estate discussion. However, I did have a business before retirement.

I got this book after reading a great review in the Orlando Sentinal. This book would have saved me a bundle had I known about this information many years ago. It is cleverly written and has a lot of good information that I myself never heard from my accountant. I especially liked all the examples and tips that I found really useful in understanding the tax planning sections I also liked the elaborations, which provided some nice insights into why Congress passed various laws or on what to do about certain laws, with a great deal of clarity and specificity.

One very unsual feature that I found in this book that I never read in any other book was all the information that was provided on how to "audit proof" each and every tax planning strategy. I have used the J.K. Lasser guide in preparing my taxes, and I have never seen as much specific information on how to IRS bullet proof each deduction as Mr. Botkin provides.

Many financial books I read are rather shallow and lack a lot of the details necessary to implement what they are suggesting. Also, there seems to be a trend in financial and real estate books to serve as a giant advertisement for consulting services or for other books. This was NOT the problem in this book, which was frankly very refreshing.

Even as a retired person, I did, however, find the real estate section to be very useful. It will save me a bundle on some real estate mistakes that I didn't know about all these years.

Some reviewer noted that this book doesn't show you how to plan for the various tax laws. He must not have read the same book that I read because this book has a lot of specificity on what to do with each applicable law.

In short: I have given a copy of this book to my son and daughter. That should tell you what I think of the book.

5-0 out of 5 stars You MUST read this book to get all you can for your family!
We all work too hard for our money to let ignorance of available tax reduction strategies keep us from our money. I thought this book would be boring and dry as most tax books are, but I was blown away by Mr. Botkin's style and delivery. The material is laid out extremely well and everything is immediately "actionable" to let you begin taking advantage of existing laws and structure. There are loads of provisions to your advantage in the tax codes, but it is your responsibility to take off the blinders of ignorance.

I have purchased a copy of this book for my lawyers and accountants and my key team as an invaluable resource. I recommend this book over every other tax strategy and tax saving book I have ever read!

5-0 out of 5 stars To all bogus reviewers such as "Be Careful"
To the person who reviewed my book as "Be careful" I don't know if you are a person with a competing book, have some sort of "ax to grind" or just dumb; however, NO WHERE in my book do I advocate setting up a home based business solely for tax benefits. The book is designed for people who specifically have a bona fide small business operated with an honest expectation of profit. In fact, had you taken the time to read my book, you would have seen that I get into this in great detail in Chapter 8, "How to Shield Yourself From The IRS Weapon of Classifying Your Business As a Hobby." See pages 109- through 130 and specifically mentioning what you note on the top three paragraphs of page 122. Also, just for the record, over the years, I have had numerous attorneys, accountants and even IRS agents comment on the depth of my business vs. hobby discussion.

I normally don't respond to reviews since I don't mind criticism of my book. In fact, I encourage it if it is fair so that I can make changes to future editions. However, you are way off the mark, and I, therefore, felt that you this needed a response.! I should note that I am always trying to give the best information in my material. If mistakes occur or if you feel that I can present it in a better manner, please send your suggestions to my email at Send it to the attention of Sandy Botkin

5-0 out of 5 stars Buying another one!
I bought this book based on the reviews and they were right. I loved it - it's straightforward, easy to read, and really has great advice! To note - this book is all about lowering your taxes by having your own business. If you're not interested in this option, this book isn't for you. My mom liked it so much I gave her my copy and I'm online to buy myself another. Highly recommend! ... Read more

5-0 out of 5 stars Solid treatment of material
We used this book as the text for a masters level course in our masters of accouting program. Students responded well and appeared to enjoy the book. They found the treatment of the material to be at an apporpriate level, and they rated the book a five on a five point anonymous rating. The only suggestion they proferred was for some companion piece covering a few of the more currently used planning techniques.

5-0 out of 5 stars Great Text For a Complex Subject
As another reviewer states, the material for this book was used in the Taxes & Business Strategy class at both the University of Chicago and Stanford's business schools. Compared to other texts on this subject, it is actually readable and, more importantly, understandable to a non-tax professional. The are an abundance of examples that you can apply directly to situations which arise in real world situations. The 2nd edition has been updated to reflect most recent changes in the tax law.

The book is a must for anybody in investment banking, law, private equity, and other fields where a tax plays a large role in determining the outcome and structure of deals, compensation, etc.

4-0 out of 5 stars A good text
Excerpts of the text are used in the Taxes and Business Strategy course at the University of Chicago Graduate School of Business. Scholes and Wolfson have provided an excellent, multi-perspective framework for thinking about tax issues and how taxes can impact the value of a transaction. Unfortunately, S&W have been making too much money in the private sector to update this book so some of the details in the book regarding tax laws are dated.

5-0 out of 5 stars A must for anyone with significant tax exposure
Having taken Wolfson's class at Stanford Business School, I can attest to the value of this book. Prof. Wolfson & Myron Scholes present the implications of certain taxation issues in an extremely clearheaded fashion. ... Read more

3-0 out of 5 stars The tittle is somewhat misleading
The publisher is definitely an expert in marketing books. The book gives you a first impression that it provides you with "New" solutions to save you money. Well, I think that is a stretch at best. (That's why 3 stars.)

After reading the book, (BTW, I bought it nearly one year ago) I realized it doesn't provide detailed solutions that might help us do-it-yourself folks to prepare tax returns, if, for instance, you're a Security trader.

The book, however, is a very good start where one may find a quite complete education on tax and estate planning, and where one may find further info. It provides many real life court cases, involving tax filings, with comments. The author does have extensive knowledge and experience in the field. But, in general, the author insists that you find a lawyer or competent accountant to do the tax returns. That's why this is not a "how-to" book. For instance, it doesn't tell me how to complete Form 3115 line by line, rather it explains the purpose of the Form and the key points one must know about the Form.

The number of issues covered in the book may be more than what one needs to know. All in all, it is a very good text for those who care to know more about their money and taxes, and the nasty surprises that IRS has in store for the unprepared. ... Read more

Tax Havens of the World (8th edition/2003) covers all the major havens, including the Caymans, Bahamas, Bermuda, Liechtenstein, Switzerland, Singapore, etc. The author has over 18 years reading and writing about tax havens and the US Tax Code that covers their use and abuse. US (domestic) estates - even with the repeal of the federal estate tax after 2010 - will still be subjected to Federal income and gift taxes, as well as State income, inheritance and estate taxes too! See page 254 of this edition.

The Bahamas, the Cayman Islands, Anguilla and Bermuda have no personal income taxes, no corporate income taxes, no capital gains taxes, no withholding taxes, no estate, gift or inheritance taxes, no sales taxes, no employment taxes, no death duties, and no probate fees. Guarantees against future taxes are provided by these governments for periods up to 50 years. Exempt trusts can receive a guarantee up to 100 years. ... Read more

4-0 out of 5 stars Learn how wealthy american fleece the working stiff
I always get a couple of laughs when I see these 'tax haven' and 'offshore banking books' marketed to the general public as some sort of panacea for confiscatory taxation. As if some working stiff (like me) can swim up to the pool bar at the hotel in the Caymans and rub elbows with other 'tax refugees' and flip the bird to the IRS. GIVE ME A BREAK. This subject was a pet hobby of mine over the last 6 years and let me tell you that unless you are in the top 1% of income earning americans this book is useless to you. Unless you have a hundred thousand dollars you can blow in attorneys fees to set up your 'technically' legal International Business Corporation, and have a team of CPA's certifiy your tax returns 'assuring' the government that you 'really really' dont own the other 98% of your corporation you can not LEGALLY use the ideas contained in this book. If you wanted an explanation of how the international tax laws work, while at the same time how you could break the tax laws and hide and deposit money in a place like the Bahamas you can use this book. BUT, no matter what type of person you are, you ought to study tax havens for 5 years before you do anything, legal or otherwise.

You need five years to see that a good portion of the 'tax haven' world is nothing but an international racket filled with international con-men. While this book may be dedicated to Patrick Henry 'Give me Liberty and Give me Death' and the American resistance against BRitish Taxation, the persons and mostly corporations illustrated in this book do nothing but fleece the working stiff.

Reading between the lines, all the americans who had to leave the United States to live in these tax free jurisdictions did so because they broke a serious law and were facing jail time. Do you really think that when they got to Costa Rica they stopped operating their business. Between tax cheating felons, guys that welshed out on their spouses in divorce settlements, or people who were sued and are escaping judgments, the tax havens themselves are filled with criminals on the lam.

Case in point, this book mentions that American Doctors facing killer lawsuits often have bank accounts and monies in tax havens because they are judgment proof! Normally Doctors have this incredible thing called 'Malpractice Insurance' that pays out on claims. If a doctor is escaping a judgment it is because he did not carry malpracice insurance (that tells you about the doctor right there) OR the Doctor committed a serious crime, like a sexual battery, in the course of his professioal duties so that his insurance company disclaimed coverage. In either case I think the picture is clear. Remember OJ Simpson going to the Isle of Mann off of England during the murder trial ;)

Furthermore, over the past 5 years I have seen the IRS and Congress move steadily in the direction of stopping tax haven activity entirely. It is mentioned in this work that you cna get an offshore debit card that looks like a regular Visa or Mastercard. So in that manner you could spend your undeclared dividends and interest in the USA. Well that was great until the IRS subpoenad all the Mastercard accounts where the receipts were generated to credit networks set off in a few key areas. Now who do you think is going to be audited.

Furthermore, there have been some spectacular bank failures in these tax havens, and remember there is no FDIC. The oft touted bank secrecy laws in these countries are great until an enterpirsing government agency gets a back door plant in these institutions with Mr. Benjamin Franklin taking the lead.

Really, this book is the best on the subject of tax havens by far. In fact I think this is the only book that has a TECHNICALLY legal way for them to be used by a U.S. Citizen. The book is well written and appears to cover all the bases, but I assure you it does not. The book is similar somewhat to a prospecuts of a risky investment or tax shelter that a bunch of clever lawyers and accountants have come up with. Technical compliance with tax laws will most likely spare you criminal prosecution if you get called on it, but of course you can still be hit with civil penalties.

As an American you should be AWARE of the existence of this aspect of international finance. You should be aware that you have monetary escape routes in the event of disaster, and really, this book will open your eyes to a world 99% of america knows nothing about, but it is no 'everyone can do it' tax shelter. This is a corporate shell game, and I believe the recent Enron debacle involved the use of offshore vehicles to disguise losses and such, that fleeces the public. With sufficient thought, it is hypocrital in the first degree to think that by allowing corporate fat cats and high net worth individuals to park billions offshore and pay no taxes, we, the wroking public, are somehow 'getting back' at the IRS. The only person getting killed here is me. Nothing more.

I give this book 4 stars because it is the best book on the subject, and is a good read. While it is romantic and fun to imagine oneself parking millions of dollars into some royal bank in Monaco and relaxing by the pool for the rest of your life while you pay no taxes, this is a pipe dream a sales pitch of this, and other books like it. ... 5-0 out of 5 stars A must read before putting your estate plan to work
I first read Beyond the Grave some years ago. I thought it was incitefull and touched on the human aspect of transferring wealth that was missing in other books that I read on this subject. I read it again recently. This time my personal situation had changed and I had a specific need for the kind of information. I found that it was written in a form that seemed to me as "personal advice".I was pleased that I could zero in on particular aspects of the book because of how wonderfully organized it was. I was further impressed by the detail of all aspects of a given question and how easily I could apply it to my personal situation. I almost felt that I was having a dialog with the Condons.
The book is full of important advice for making difficult decisions that can effect the lives of your loving beneficiaries after you are gone. Information and ideas that I could not have thought of without the assistance of this book. I holdheartedly recommend this book.

5-0 out of 5 stars Loved It!
I recently bought the book "Beyond the Grave" just after my second parent passed away and was pleasantly surprised at how easy it was to read about such a morbid subject. I only wish my parents would have taken the advice from the Condons and had left their inheritance equally to me and my 5 siblings so that no feelings would have been hurt when distributing items listed in the family trust. I highly recommend parents of all ages to read this book and use it as a guideline for their living trust.

4-0 out of 5 stars Everyone Can Learn Something from this Book
I thought this book pointed out many types of situations and gave good ideas and strategies for avoiding problems both while you are living and after you die and leave your assets to your beneficiaries. I did, however, feel that a lot of the examples were geared for those with significant estates. Most of the examples discuss people with estates well over $1,000,000. With that being said, even though my estate doesn't come close to this amount, the author gave me a lot to think about and I felt he had excellent advice -- even if all of it didn't apply to my particular situation.

In my opinion, no matter how big or small your estate is, this book is worth the read if you are planning your estate. I feel that everyone has something to learn from the various situations the authors discuss in their book. Thank you Gerald and Jeffery Condon for being the eyes and ears from beyond the grave and helping us all learn from yours and your many clients mistakes.

5-0 out of 5 stars Best Book on Estate Planning
The #1 reason I bought this book compared to other estate book is because of the wonderful reviews. This is the second estate book that I've read. Reading this book from cover to cover says it all. It is a fantastic book on estate planing. The first estate book left me a bit comfused, but after reading this book I understand it all. Don't make a will or living trust without first reading this book. It has human nature emotions and question that you are too scared to ask. It even have the consequences of making decision based on other people experience.

4-0 out of 5 stars Required Reading if you're doing an estate plan
This book gets you thinking about all the pitfalls in deciding who you should leave your money to, and with what stipulations. How do you avoid the mistakes other people have made?

I have read about 9 estate planning books and talked to one attorney. This book gave me crucial advice that I did not find anywhere else. The stories and advice changed my mind about what I will do, because I have learned from the dozens of situations Mr. Condon experienced over the years.

The book is not a masterpiece. And you may need one or two other books to round out your knowledge. However, it is clearly written, well organized, and rather entertaining.

I give it 4-1/2 stars, and suggest it as required reading for anyone creating a will. ... Read more
