Book Description

The U.S. Supreme Court, far from being above the political fray, has consistently made decisions that affect the electorate in profound ways—Bush v. Gore being but one example. This revised edition of the first over-all consideration of the role of the court in the electoral process is provocative and eye opening.

Of the first edition, CHOICE said, THE U.S. SUPREME COURT AND THE ELECTORAL PROCESS "plumbs the Supreme Court’s constitutive apolitical role as ‘primary shaper of the electoral system’ and reveals the pervasive involvement of the Court in the political process."

The U.S. Supreme Court—at least until Bush v. Gore—had seemed to float along in an apolitical haze in the mind of the electorate. It was the executive branch and the legislative branch that mucked about in politics getting dirty, the judicial branch kept its robes—and nose—clean. THE U.S. SUPREME COURT AND THE ELECTORAL PROCESS makes it abundantly clear however that before, during, and after the judicial decision that made George W. Bush the President of the United States, everything was, is, and will likely be politics—including the decisions handed down by the highest court in the land.

This revised and updated edition takes into account not only the recent judicial decision on the Presidency, but a myriad of others as well in which the U.S. Supreme Court has considered the constitutionality of a wide range of issues involving voting and elections, representation, and political participation. Practitioners and academics in both law and political science examine a number of court actions that directly affect how we choose those who govern us, and how those decisions have affected our electoral politics, constitutional doctrine and the fundamental concepts of democracy, including: racial redistricting, term limits, political patronage, campaign finance regulations, third party ballot access, and state ballot initiatives limiting civil liberties. ... 5-0 out of 5 stars Almost made me
want to go out and get in a fender-bender myself. We've all seen the famous Driver's Ed movies about the deadly physical and emotional consequences of auto accidents, but rarely has there been such in-depth treatment of the risk management and allocation consequences. I've read many books on insurance (and even reinsurance), but with the exception of Ostrager and Vyskocil's work, none have kept me turning the pages like Phillips and Chippendale. Look for more brilliance from this duo; the Simon and Garfunkel of the no-fault insurance literary community.

5-0 out of 5 stars No-fault? It's your own dam fault if you don't buy this book
While I have long followed the work of Jerry J. Phillips, it is more than obvious to the intelligentsia that Stephen Chippendale is the powerhouse in this dynamic duo. Chippendale takes the reader on a tour de force fandango adventure in the no-fault world, it really is quite first rate. He might be a younger attorney, but that is not about to intimidate that bad boy ... Read more

5-0 out of 5 stars Sam Black: A Truely Great Man
My late grandfather was the hardest working man I have ever known. He and Prof. John Rossi (Penn State Erie) spent years working on this part narrative, part history of the growth of the auto insurance industry in its early years. I would not buy this book for casual reading. It can be a bit dry. However, if you want to read about the growth of the American automobile insurance industry, then this is a very informative read. My grandfather always emulated the "bootstrap" Americans of real life and of literature like Horatio Alger. He recounts this influence in the context of the wide open years of insurance underwriting. Prof. Rossi does a good job of capturing the sprit of this man who's tenure with the Erie group of insurance companies lasted 70 years from 1927-1997, and saw the company grow from the original investment from H.O. Hurt and Ollie Crawford (the Founders of Erie Insurance) to the multi-billion dollar corporation it is today (listed as the 1748th largest company in the world today in the 2004 Forbes 2000 Index). Grandpa, I will always love you and I miss you. ... Read more

Download Description

Prior to the 1990s, the UK motor insurance market was dominated by brokers and traditional insurers, supported by a number of smaller, more specialised insurance providers. However, Direct Line entered the market in 1985, and in doing so signalled the advent of the direct insurance sellers. Their telephone-based, low-cost, low-overhead approach to insurance went on to revolutionise the market, and their methods have since been widely imitated by new entrants and existing players alike. This shift in emphasis from traditional brokers and insurance companies is also largely responsible for the other major trend within the motor insurance market over the last ten years, which is the explosion of competition and the associated fall in profit margins. Insurance companies have been forced to reduce premiums in order to maintain their market share, leading to periods of widespread losses in both the early and the late 1990s. On each occasion the losses have been followed by a widespread rise in premiums in an attempt to bring the market back into profitability. Needless to say, any price rises were tempered by the constant need to remain competitive in what is a highly price-driven market, and as such it would seem that the market is caught in a cycle of price cuts, followed by premium increases. These premium increases then give companies scope to increase market share by cutting prices, thereby restarting the cycle of price falls and rises. Aggressive price-cutting was not, however, the only reason for the dramatic losses incurred by motor insurers. Recent legislative changes affecting compensation paid to accident victims have increased the average cost of claims, and there are signs that the US-style 'compensation culture' is starting to have an impact on this side of the Atlantic. There were additional fears that the trend towards increased pay-outs would be amplified by measures introduced which allow the NHS to claim back costs associated with road traffic accidents, but as yet this seems to have had a minimal effect on the market. This report aims to address the key issues affecting motor insurance providers, and to give an indication of how Mintel believes the market will develop over the coming years. The main background factors are examined, and past performance and trends are analysed. The major players in the market are identified, with details of market share and earned premium income from motor insurance. At present there is a strong trend towards consolidation, of which last year's merger between CGU and Norwich Union is just the most visible example. This merger created a new market leader, CGNU, which now provides almost one quarter of all private motor insurance. CGNU is profiled, along with the Royal & SunAlliance, AXA, Direct Line and Zurich Financial services, who together go to make up the five largest underwriters in private motor insurance. For some years it has been predicted that the Internet could transform the 21st Century motor insurance industry, just as Direct Line's innovations transformed the industry in the late 1980s and early 1990s. As yet it would appear to have had a negligible effect in terms of policies sold, but numerous underwriters and brokers have made significant attempts to gain a head start in this developing market. These measures, and the prospects for future growth, will be examined in this report. Another area of growing importance is that of non-standard risks. This sector is examined, and the leading providers are also profiled. Specially commissioned consumer research was undertaken by Mintel in February 2001, to gauge the attitude of a sample of 1,896 adults towards motor insurance. The research asked consumers how and where they bought their last insurance policy, and examined the main reason for choosing a particular provider. Provider loyalty was also considered. The results re-affirmed that there is still scope to develop this market, and that consumers are increasingly happy to change providers given the right conditions. ... Read more

Book Description

This book updates an earlier study in which the authors estimated the effects of a choice automobile insurance plan on the costs of compensating auto accident victims in which the no-fault option was absolute no-fault (ANF). In their current analysis, using 1992 data, the authors replicate their analyses for 46 states and find that the choice plan could substantially reduce the costs of compensating people injured in auto accidents. ...
